On 17 September, the European Commission published its proposal for the EU KIDS Act<\/a>: one EU regulation that would give every child a high level of protection, enforced directly at European level for the largest platforms.<\/p>\n\n\n\n

In a nutshell, there are two parts. First, age<\/strong>. It delays social media usage of children by prohibiting social media accounts under 13 and providing for parent-supervised \u201cmini-accounts\u201d at between 13 and 15. Second, design<\/strong>. It regulates how services must be built so they are safe by design (e.g. limitations on profiling and recommendations, no addictive tricks leading to excessive use and exposure, no unwanted contact, safe settings by default, and no spending traps). With these two pillars, the Commission expects that children will gradually gain access to the online world with safe services as they grow up.<\/p>\n\n\n\n

Linked with age limits, the safety-by-design rules extend well beyond social media, covering video platforms, games, app stores, and even AI chatbots and companions. Under the proposal, AI companions accessible to minors would be barred from simulating human relationships in ways likely to foster emotional dependency.<\/p>\n\n\n\n

\u201cVery large online platforms\u201d, those with 45 million or more active monthly users in the EU, will have to prove themselves safe to use. Before their services come into contact with children under the new rules, they must submit a detailed compliance plan, independently audited at their own expense. Smaller platforms must follow the same rules, but rather than facing this direct Commission oversight, they will be supervised by national Digital Services Coordinators in each Member State.<\/p>\n\n\n\n

The rules will be phased in gradually. Within six months, platforms must check existing accounts and disable those belonging to under-15s, while also meeting the new safety-by-design requirements. Within twelve months, further measures kick in, including parental account tools, stricter rules for AI chatbots, and a faster enforcement process allowing the Commission to act within 30 to 90 days when rules are broken.<\/p>\n\n\n\n
